Terms of Use
1. Who we are and what these terms cover
MemoCards is offered by Xiyang Lyu, Saarbrücker Str. 268, 66125 Saarbrücken, Germany (“we”, “us”). These terms apply to the MemoCards apps for iPhone, iPad and Mac and to the online services behind them: accounts, sync and AI deck generation.
Your licence to use the app itself is granted under Apple's Licensed Application End User License Agreement. These terms add the rules for our online services. Where they conflict, these terms apply to the services and Apple's agreement to the app.
2. Your account
You can use MemoCards without an account. To use sync or AI deck generation, you need one. You must give a valid email address or sign in with Apple or Google, keep access to it secure, and not share your account with others. You are responsible for what happens under your account unless you are not at fault.
3. Your content
Decks, cards, images, documents and everything else you create or import remain yours. You grant us only the rights we need to store, process, transmit and display that content in order to provide the service to you — for example, to sync it to your devices or to send a document to an AI provider when you ask for a deck to be generated.
You may only upload or import content you are entitled to use. You must not use MemoCards for content that is unlawful, infringes the rights of others, or is intended to harm our systems or other users.
4. AI deck generation
AI-generated cards are produced automatically by language models. They can be incomplete, inaccurate or misleading, and may not reflect the source faithfully. Review every card before relying on it, particularly for exams, professional or medical subjects. Generation is subject to the limits of your plan (for example, pages per month) and may be temporarily unavailable when our providers are.
5. Subscriptions
AI deck generation requires a MemoCards subscription, which is bought through Apple's App Store. Apple is the seller and processes payment, and Apple's terms govern the purchase, including billing, refunds and any statutory right of withdrawal.
- The price and billing period are shown in the App Store before you confirm the purchase.
- The subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends.
- Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel the subscription in your Apple Account settings at any time. Cancelling stops the next renewal; access continues until the end of the period you have paid for.
Sync is currently free. If we change which features need a subscription, we will announce it in the app in advance, and it will never affect a period you have already paid for.
6. Availability and changes
We work to keep the service available, but we cannot guarantee uninterrupted operation; maintenance, network problems or outages at our providers can interrupt it. Keep an export of study material that matters to you. We may develop the service further and change features, provided the changes are reasonable for you.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breach of an obligation that is essential to the purpose of the contract and on which you may rely (a cardinal obligation), and then only for damage that was foreseeable and typical for this kind of contract. Otherwise, liability for slight negligence is excluded. These limitations also apply for the benefit of the people we work with.
8. Ending the agreement
You can stop using the service and delete your account in the app at any time. We may end your access to the online services with reasonable notice, or immediately for good cause — in particular for a serious breach of these terms. A subscription you have paid for is unaffected until the end of its current period unless we end access for good cause.
9. Changes to these terms
We may update these terms for good reason, such as new features, changes in law or in our providers. We will tell you about significant changes in the app at least 30 days before they take effect. If you do not agree, you can delete your account before then.
A German version of these terms is available; if the two differ, the German version prevails.
10. Governing law and disputes
These terms are governed by German law. If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
